Großbordell bleibt trotz Razzia wohl geöffnet
Large brothel stays open despite police raid
Nach dem Polizeieinsatz prüfte das Bezirksamt, ob das Bordell in Berlin-Halensee zu schließen sei. Nun schafft ein Wechsel in der Geschäftsführung neue Tatsachen, von Sabine Beikler

Berlins größtes Bordell "Artemis" in Halensee wird nach einer Großrazzia Mitte April wohl nicht geschlossen. Das Bezirksamt hatte nach der Durchsuchung mit 900 Beamten von Zoll, Polizei und Steuerfahndung eine gewerberechtliche Prüfung angeordnet. Nach Tagesspiegel-Informationen gab es im Mai jedoch einen Wechsel in der Geschäftsführung, sodass Gründe, die eine Schließung nach Gewerberecht gerechtfertigt hätten, offenbar weitgehend obsolet geworden sind.
Berlin's largest brothel, the "Artemis" in Halensee will not be closed as a result of a large-scale raid in the middle of April (2016). The Bezirk administration had ordered an investigation after a raid by police, customs and taxmen (totalling 900 strong). According to information available to the Tagesspiegel, there was however a change in management in May as a result of which any reasons which justified the shutting down of the establishment because of trading irregularities, have become apparently largely obsolete.
Die bisherigen Geschäftsführer, die Brüder S., sitzen weiterhin in Untersuchungshaft. Ihnen werden unter anderem Verdacht des Menschenhandels, die Vorhaltung von Sozialversicherungsbeiträgen und Steuerhinterziehung in Höhe von insgesamt 23 Millionen Euro vorgeworfen.
The owners up till now, the brothers S., are still in custody. They are under suspicion of trafficing, and the evasion of social security contributions and tax to a sum of 23 million euro.
Die Artemis-Betreiber traten als Saubermänner des Sexgewerbes auf. Sie warben auf BVG-Bussen und beschäftigten bis zu 40 Angestellte. Bis zu 100 professionelle Prostituierte arbeiten in dem 2006 eröffneten Bordell. Die Brüder S. stehen im Verdacht, die Prostituierten offiziell als Selbstständige beschäftigt zu haben. Faktisch aber sollen die Frauen wie Angestellte in ein per Dienstplan geregeltes Schichtsystem eingebunden gewesen sein. Es hat nach Tagesspiegel-Informationen eine Arbeitspflicht und eine Kleiderordnung bestanden. Die Frauen sollen keine eigenen Zimmer gehabt haben und mussten auch einen von Artemis beauftragten Arzt regelmäßig aufsuchen. Außerdem sollen die Brüder S. Kontakte zu einschlägig bekannten Hells Angels gehabt haben. Die staatsanwaltschaftlichen Ermittlungen laufen.
The owners entered the sex business with a clean slate. They advertised on Berlin BVG buses and employed up to 40 people. Up to 100 professional prostitutes worked in the brothel, which was opened in 2006. The brothers S. are accused of taking on the prostitutes officially as self-employed while in fact the women worked, just like employees, in a rota system. According to information given to the Tagesblatt, there was a certain obligation to work and also regulations on clothing to follow. The women did not have their own rooms and had to subject themselves regularly to examinations by a doctor contracted by Artemis. Apart from this, the brothers S. had had contact with Hell's Angels. Official investigations are continuing.
Bei einer gewerberechtlichen Prüfung wird die persönliche Zuverlässigkeit zum Führen eines Gewerbes geprüft. Dazu zählen polizeiliches Führungszeugnis, Auskunft aus dem Gewerbezentralregister oder Bescheinigungen in Steuersachen. Häufig kommt es bei laufenden Ermittlungen zu Inhaberwechseln - wie auch im Fall der Artemis GmbH.
As part of an investigation, the personal reliability for running a business will be examined. This requires things like police certication, information from trade register or tax certicates. A change in ownership often occurs during such investigations, and that is what has happened here.
Laut Handelsregisterauszug sind die Brüder S. keine Geschäftsführer der Artemis GmbH mehr. An ihrer Stelle wurde Florian G. eingetragen. Die gewerberechtliche Prüfung beginnt also wieder von vorn. "Bei einem neuen Geschäftsführer geben wir eine Prognoseentscheidung ab", sagte Ordnungsstadtrat Marc Schulte (SPD) dem Tagesspiegel.
According to an extract from the trade registers, the brothers S. are no longer owners of Artemis. Instead of them, the name of Florian G. has been entered. The investigation therefore begins again from the beginning. "For a new owner, we provide a decision based on estimation", said Ordnungsstadtrat Marc Schulte (SPD) to the Tagesspiegel.
Grundsätzlich gilt in Deutschland Gewerbefreiheit. Hürden für die Untersagung eines Gewerbes sind entsprechend hoch. Nach Einschätzung von Wirtschaftsprüfern ist davon auszugehen, dass eine Schließung durch einen Wechsel wie bei Artemis erschwert wird - vorausgesetzt, es liegt kein Grund vor, die persönliche Zuverlässigkeit des neuen Geschäftsführers infrage zu stellen.
Fundamentally, freedom of trade reigns in Deutschland. The closing-down of a business is very difficult. After an estimation of the economic standing it can be assumed that a closing of Artemis is made more difficult by the change in direction, just as long as there is no reason to bring the personal reliability of the new management into doubt.
